GENERAL TERMS AND CONDITIONS OF USE OF THE TRIPLTRIP PLATFORM, GENERATOR OF LOYALTY PROGRAMMES


1. CHARACTERISTICS AND OPERATION OF THE PLATFORM


The Tripltrip Loyalty Platform (the Platform) is offered by the Tripltrip Company to establishments (the Hotels or the Hotel) that have set up a loyalty programme (the or one Programme) on their behalf. The Members registered on the Platform for a Programme will enjoy the benefits described on the Tripltrip application, available on their smartphone (the Application), during their visits to the Hotels or the Hotel using the Platform.
The current discount amount will be deducted from the Member's bill by the Hotel at the time of the booking or at the end of the Member's stay on presentation of the QR code of his/her valid virtual loyalty membership. This QR code contains the Member's first and last name, the Programme expiry date (if required), the Member's individual identification number, the level of discount that has been achieved and the list of benefits to which the Member is entitled.

2. HOTELS USING THE TRIPLTRIP PLATFORM

The Hotels or the Hotel listed in the application form participate(s) in the Programme chosen by the Member. In the event that a Hotel ceases its Programme after the booking has been made but before the stay, the Member will benefit from the discounts, benefits and special offers to which he/she was entitled at the time of booking.
A Member may be registered for several Programmes, but these Programmes are not linked. Each Programme is independent unless expressly indicated on the Platform by the Hotels.

3. JOINING A PROGRAMME

3.1. CONDITIONS OF MEMBERSHIP

Any individual who has reached the age of majority and/or legal capacity under the laws of the Member's country is eligible to become a Member. Membership of a Programme is free and is obtained by registering in the Application. Membership is strictly personal and cannot be sold or lent. It is not a means of payment. Each Member may hold only one Loyalty Membership in a Programme. If the Member travels with his/her immediate family (strictly spouse and children under the age of 18), the current discounts and benefits will apply to all rooms occupied by the family group during a stay on the same dates.

The Member must not disclose their membership number or password to anyone. They are responsible for all transactions to and from their account. An individual email address is required to join the Platform. The same email address will not be accepted for two members. Members accept that the Programmes may be modified in whole or in part at any time and without notice and that they can review the changes by consulting the current version of the Terms and Conditions or their Application.

3.2. MEMBERSHIP PROCEDURE

Prospective Members can join a Programme by downloading the Tripltrip application from their mobile phone's store and using the pairing code provided by the Hotel. Once registered and paired, they can use their account and benefit from all the services of the Programme to which they have subscribed.

4. USE OF MEMBERSHIP

The Members are required to:
- Present their virtual membership (QR code) upon arrival at the Hotel,
- Not lend or transfer their membership to third parties,
- Not attempt to fraudulently obtain discounts or benefits.
The Member undertakes to comply at all times with these General Terms and Conditions of Use of the Platform.

5. CANCELLATION TERMS AND PROCEDURES

5.1. INITIATED BY THE MEMBER

The Member may decide at any time to terminate their participating in a Programme. Such cancellation shall constitute a complete withdrawal from the Programme the definitive termination of all relations between the Programme and the Member. The Member can carry out this cancellation in the Application. Such cancellation shall entail the loss of the discount obtained and the benefits acquired on the date of cancellation.

If the Member decides to unsubscribe from the Platform, the deletion of the Member's personal data from these databases will take effect within 48 hours from the date of termination of the Platform.

5.2. INITIATED BY THE HOTELS OR TRIPLTRIP

Any use of the Membership to a Programme and/or the Platform contrary to the present General Terms and Conditions of Use may result in the immediate cancellation of the Membership, the discount rate and the benefits acquired, as well as the closure of the Member's account, without the Member being able to claim any compensation for any reason whatsoever.

6. OPERATION OF THE LOYALTY PROGRAMME

6.1. RULES FOR OBTAINING DISCOUNTS AND BENEFITS IN HOTELS USING THE PLATFORM

Discounts will be applied directly and immediately by the Hotel to the Member's bill at the time at the time of the booking or at the time of payment of the bill.
Programme Members will receive discounts and benefits that increase with to the number of stays or amounts spent according to the Programme, as follows:
- The reservation must be made directly with the hotel, via the hotel's website, by telephone, e-mail, etc., without using any third party intermediaries,
- The discount will be applied to the total amount of the bill for the room(s),
- Discounts earned during stays do not add up,
- Benefits earned during stays are cumulative.

6.2. DISCOUNTS AND BENEFITS

6.2.1. Discounts

Discounts are earned and increase according to the number of stays or amounts spent, as defined by the Hotels in their own Programme displayed on the Application.

Two or more bookings made at the same hotel on consecutive dates will be considered as a single stay.

6.2.2. Benefits

Benefits are earned over the course of stays or amounts spent and are cumulative, as defined by the Hotels in their own Programme displayed on the Application.

Some benefits are subject to availability, which means that due to circumstances relating to room availability, the Hotel may not be able to honour one or more of these benefits. By enrolling in the Programme, the Member acknowledges the possibility of such circumstances and waives his/her right to the benefits in such event without any right to a refund.

6.2.3. Activity period

If the Programme includes an activity period condition, the Member must stay at the Hotel at least once before the end of this period to avoid being downgraded one reward level.

6.3. DISCOUNT PROCEDURE

If the booking engine on the Hotel's official website is able to apply discount levels, Members are invited to enter the code corresponding to their discount level when booking. Otherwise, the discount will be applied to the bill at the time of payment.

In all cases, and before the invoice is issued, the Member must present the QR code provided in his/her application at the reception desk. The Hotel will scan it to collect the following information:
- The Member's first and last name,
- The Member's unique identification number,
- The expiry date of membership (if required),
- The discount level achieved,
- The list of benefits to which the Member is entitled.
The Hotel will scan the QR code to check the level of discount achieved, which will be applied to the amount of the bill. The Hotel will then send the discounted invoice amount to the Member's Tripltrip application and the Member must receive it immediately.
The discount level will be automatically increased if the conditions defined by the Hotel in the Application are met.

6.4. PROCEDURE TO BE FOLLOWED IN RELATION TO BENEFITS

Once the direct booking has been made and the confirmation email from the Hotel has been received, the Member is invited to send an email back to the hotel confirming their status as a member of the Programme and requesting the benefits they wish to enjoy during their stay. Certain benefits are subject to availability.
The number of benefits is automatically increased if the conditions defined by the Hotel in the Application are met.

7. JURISDICTION

Membership of the Platform implies the Member's unreserved acceptance of these Terms and Conditions. These Terms and Conditions replace all previous texts.
In the event of a dispute between a Member and Tripltrip, the parties agree to first seek an amicable settlement.

FRENCH LAW SHALL APPLY EXCLUSIVELY. Any dispute or difference arising from these Terms and Conditions which cannot be resolved amicably between the parties shall be submitted to the competent courts of Paris.
